Of the two, California law is much more strict, and potentially much more expensive.<\/p>\n<p>The Federal OSHA standard is vague, &#8220;An employer has an obligation under the General Duty Clause, Section 5(a)(1) to keep their workplace free from recognized serious hazards, including ergonomic hazards.&#8221; But the way in which these goals can be achieved is unclear.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-1294 aligncenter\" src=\"https:\/\/www.ergodirect.com\/blog\/wp-content\/uploads\/2017\/11\/Meaning_Posture_With_Words_shutterstock_258621503.jpg\" alt=\"\" width=\"671\" height=\"447\" srcset=\"https:\/\/www.ergodirect.com\/blog\/wp-content\/uploads\/2017\/11\/Meaning_Posture_With_Words_shutterstock_258621503.jpg 4800w, https:\/\/www.ergodirect.com\/blog\/wp-content\/uploads\/2017\/11\/Meaning_Posture_With_Words_shutterstock_258621503-300x200.jpg 300w, https:\/\/www.ergodirect.com\/blog\/wp-content\/uploads\/2017\/11\/Meaning_Posture_With_Words_shutterstock_258621503-768x512.jpg 768w, https:\/\/www.ergodirect.com\/blog\/wp-content\/uploads\/2017\/11\/Meaning_Posture_With_Words_shutterstock_258621503-1024x683.jpg 1024w, https:\/\/www.ergodirect.com\/blog\/wp-content\/uploads\/2017\/11\/Meaning_Posture_With_Words_shutterstock_258621503-405x270.jpg 405w\" sizes=\"auto, (max-width: 671px) 100vw, 671px\" \/><\/p>\n<p>Fortunately, the legal obligations California businesses must meet are online, and easily available to any business with a computer.<\/p>\n<p><strong>Employer responsibilities<\/strong><\/p>\n<p>California Labor Code <a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=LAB&amp;sectionNum=6400.\">\u00a76400<\/a>\u00a0provides that every \u201cemployer shall furnish employment and a place of employment that are safe and healthful.\u201d<sup>1<\/sup>\u00a0California Labor Code <a href=\"http:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=LAB&amp;sectionNum=6401.\">\u00a76401\u00a0<\/a>requires employers to do everything \u201creasonably necessary to protect the life, safety, and health of employees.\u201d<sup>2<\/sup>\u00a0In addition to these broad obligations, employers covered under Cal\/OSHA must do the following:<\/p>\n<ul>\n<li>Establish, implement and maintain an effective injury and illness prevention program (IIPP).<\/li>\n<li>Establish or update operating procedures and communicate those procedures to employees.<\/li>\n<li>Immediately report any serious injury, illness or death of an employee, occurring in a place of employment or in connection with employment. \u201cImmediately\u201d here means \u201cas soon as practically possible but not longer than 8 hours after the employer knows or with diligent inquiry would have known\u201d<sup>3<\/sup>about the incident or death. In extenuating circumstances, employers must report no later than 24 hours after the incident.<\/li>\n<li>Inspect workplaces to identify and correct unsafe and hazardous conditions.<\/li>\n<li>Keep records of work-related injuries and illnesses, unless exempted by the regulations.<\/li>\n<li>their rights and responsibilities.<\/li>\n<li>Make sure employees have and use safe tools and equipment and properly maintain this equipment.<\/li>\n<li>Prevent discrimination against employees who exercise their rights under Cal\/OSHA.<\/li>\n<li>Post citations at or near work areas where an accident took place.<\/li>\n<li>Post, in a prominent location within the workplace, the Cal\/OSHA poster, informing employees of<\/li>\n<li>Provide medical examinations and training when required by Cal\/OSHA standards.<\/li>\n<li>Train employees.<\/li>\n<li>Use color codes, posters, labels or signs to warn employees about potential hazards.<\/li>\n<\/ul>\n<p>Cal OSHA also provides employers with a consulting service that can audit their work environment and help optimize the safety and productivity of employees. Cal OSHA generally will not cite employers for violations their audits uncover as long as the business is willing to resolve the issues in a reasonable time period.
